Please read these terms and conditions carefully.

The Terms and Conditions of product sales are limited to those contained herein.  Any additional or different terms or conditions in any form delivered by you (the customer) are hereby deemed to be material alterations and notice of objection to them and rejection of them is hereby given.

By accepting delivery of the product(s) the customer agrees to be bound by and accepts these terms and conditions, unless the customer and seller have signed a separate agreement, in which case the separate agreement will govern.  

These Terms and Conditions constitute a binding contract between the Customer and Seller and are referred to herein as either “Terms & Conditions” or this “Agreement”.  Customer accepts these Terms and Conditions by making a purchase from the Seller’s Website or by placing an order with one of the AIS sales associates.  These Terms and Conditions are subject to change. Customer consents to receiving electronic records, which may be provided via Web browser or e-mail application.

Customers may withdraw consent to receiving electronic records by e-mailing a written request to remove@aisink.com or by calling the Seller  (800) 805-7720 and requesting non-electronic forms.  Electronic signatures (or copies of signatures sent via electronic means) are the equivalent of written and signed documents.

ORDER ACCEPTANCE POLICY

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.  AIS, INC., hereafter referred to as AISINK.COM, AIS, INC. and  A.I.S., reserves the right at any time after receipt of your order to accept or decline your order for any reason. 

All orders placed over $1500.00 must be pre-approved with an acceptable method of payment, as established by our finance & credit department.  We may require additional credit information or verifications before accepting any order. AIS, INC. is a distributor & reseller to “end user” customers. We do not accept orders from wholesalers, exporters, computer dealers or other customers who intend to resell the products offered by AISINK.COM

Customer may issue a purchase order for administrative purposes.  Additional or different terms and conditions contained in any such purchase order will be null and void, unless they are agreed to by AIS, INC. with corresponding signature of an AIS, INC. authorized representative.

RISK OF LOSS

If a Customer provides the Seller with the Customer’s Freight Carrier Account number or selects a carrier other than the Freight Carrier(s) that regularly ship for the Seller, title to products and risk of loss or damage during the shipment pass from the Seller to the Customer upon delivery to the carrier (FOB Origin=Freight Collect).

For all other shipments, title to products and risk of loss or damage during shipment pass from Seller to Customer upon delivery to the specified destination (FOB Destination=freight prepaid and added).  Title to Software will remain with the applicable licensor(s) and the Customer’s rights therein are contained in the license agreement between such licensor(s) and Customer.

PAYMENT TERMS

AISINK.COM accepts Visa, Mastercard & American Express credit cards.

Customer agrees to pay the total purchase price for the products, plus shipping costs (if applicable). Invoices are due and payable within the terms outlined on the Invoice and measured from the invoice date, subject to continuing credit approval by Seller.  Seller may issue Customer an invoice for partial shipments. 

Customer will pay for and will indemnify and hold Seller and its Affiliates harmless from any applicable sales, use, transaction, excise or similar taxes and any federal, state or local fees or charges, including but not limited to environmental or similar fees, imposed on or in respect of or otherwise associated with any of the products or services provided by AIS, INC.  Customer must claim any exemption from such taxes, fees or charges at the time the order is placed.  Customer is responsible for providing Seller with the necessary information needed to support the exemption.

NOTE: At the time your order is placed, AISINK.COM will attempt to obtain an authorization on your credit card for the total amount of your order. This authorization is not a charge but may utilize a portion of your credit limit, thus making that portion of your credit line unavailable for other use.  In the event that your order is delayed or canceled, the authorization will expire and the amount reserved against your credit line will be released, making those funds again available for use. The amount of time it takes for an authorization to expire is governed by the policies of the bank that issued your credit card. Most expire between 1-10 days. 

	Net 30 terms are available for established accounts with approved credit, and for those who complete our credit application (PDF) and are approved for credit terms. Estimated credit application processing time is 1-2 weeks.

In the event a payment received from a terms account is returned from the bank unpaid, Customer agrees to pay a In-Sufficient Funds Fee of $35 for each check payment that is returned to cover the cost of collection fees and bank charges. AIS, INC. reserves the right to re-evaluate the established terms for any account whose payment has been returned unpaid from the bank.

Customer agrees to pay interest on all past-due sums at 1.5% per month or the maximum allowable by law, whichever is less.  In the event of payment default, Customer agrees to pay all attorney’s fees & costs incurred for the collection of any Invoice, whether or not a suit is filed. If payments are not received as stated above, Seller reserves the right to suspend shipment of any pending or future orders, as well as any previously approved credit terms until payment is received.

PRICING INFORMATION

Seller reserves the right to make adjustments to pricing for reasons including, but not limited to, changing market conditions, product discontinuation, product unavailability and Manufacturer price changes.  All orders are subject to product availability.

TYPOGRAPHICAL ERRORS

In the event a product is listed with incorrect information or at an incorrect price, due to a typographical error or error in pricing & product information provided by our Suppliers, AIS, INC. shall have the right to refuse or cancel any orders placed for the product(s) listed at the incorrect price.

AIS, INC. also reserves the right to cancel any such order, whether or not the order has been confirmed and your credit card charged. In the event your order is canceled after your credit card is charged, AISINK.COM will promptly issue a full refund to your credit card.

SHIPPING INFORMATION

• Orders received Monday–Friday by 4pm Pacific Time will be processed the same day.
• Orders received on Saturday or Sunday will be processed on the next business day.
• Orders that are in stock, typically ship out the same day, as long as they are received by 4pm & payment verification has been confirmed.
• Once confirmed, all orders will be e-mailed a confirmation with an estimated ship date and shipping cost, if applicable.
• Shipping times vary based on availability.  If the item(s) you order are in stock, we will ship as soon as possible from one of our distribution centers throughout the United States.  Although our goal is to always utilize the distribution center closest to your “ship to” location, this may vary occasionally based on the availability of the item(s). Below is a general guide of transit times:

Ground Shipments: 1-8 business days
Second day: The afternoon of the second business day after shipment
Next day standard: The afternoon of the next business day after shipment
Next day priority:  The afternoon of the next business day after shipment

• AISINK.COM offers FREE ground shipping for all toner & ink orders totaling $300 or more.  
• Additional fees apply for express shipments and next day delivery guarantees.
• Additional fees may apply to shipments outside of the contiguous United States
• We utilize a variety of freight carriers; if you have a preference or special request please note it in the comment section of your order. We will make every effort to fulfill your request.

 

NOTE:  We strive to keep shipping costs as low as possible. Please note that while our rates are based on actual shipping costs, these costs can vary considerably depending on the shipment method, the package size & weight, the location of the warehouse and the shipping destination. WARRANTIES 

Customer understands that Seller is not the manufacturer of the products purchased by the Customer hereunder and the only warranties offered are those of the manufacturer, not seller or its Affiliates. 

AIS, INC. provides a 100% satisfaction guarantee for the products sold to be free of defects in materials and workmanship. Because we offer a variety of products from a variety of manufacturers, our warranty periods vary per item classification. The following is a general outline of the product warranty periods as they apply to some of the general categorization levels offered on our site.

Any warranty information contained within the Technical Specifications field of an individual item supersedes the warranty information outlined below:

Premium & Compatible Toner Products
Premium & Compatible Toner Cartridges and Drum Units are guaranteed to be free from defects in materials and workmanship for 1 year from the original invoice date or until the toner is depleted, whichever comes first. AISINK.COM will, at our option, replace the cartridge/unit or issue a credit for the full purchase price of any cartridge or unit found to be defective.

We also warrant that, subject to the conditions outlined below and under normal use (including the operation of printer equipment within specifications) our compatible printer cartridges will not cause damage, abnormal wear, or deterioration to any laser printer.

If a defect in a printer cartridge/unit causes a printer to fail, we will reimburse our customers the full amount of all service and repair charges for the printer that is determined to have been damaged by the defective product. 

This warranty is dependent upon the customer providing AIS, INC. with satisfactory evidence that the printer failure was due to a defect in the printer product that was supplied by AIS, INC. or AISINK.COM.

Such evidence must include a written statement on the service company’s letterhead, dated and signed by the company’s field or service representative.  The defective product must also be returned in the original packaging with protection.  Any return received without proper packaging will not receive credit.

AISINK.COM’s liability hereunder shall be limited to the replacement or reimbursement as provided above. This warranty is exclusive and in lieu of all other warranties. 

Compatible Ribbons
Compatible Ribbons are guaranteed to be free from defects in materials and workmanship for 6 months from the original invoice date. Any warranty information contained within the Technical Specifications field of an individual item supersedes the warranty stated previously. AISINK.COM will, at our option, replace the ribbon or credit the full purchase price of any ribbon found to be defective.

Thermal Transfer Ribbons
Compatible Thermal Transfer Ribbons are guaranteed to be free from defects in materials and workmanship for 6 months from the original invoice date. Any warranty information contained within the Technical Specifications field of an individual item supersedes the warranty stated previously.  AIS, INC. will, at our option, replace the ribbon or credit the full purchase price of any ribbon found to be defective.

Stock Thermal Transfer Labels
Stock, compatible Thermal Transfer Labels are guaranteed to be free from defects in materials and workmanship for 6 months from the original invoice date. Any warranty information contained within the Technical Specifications field of an individual item supersedes the warranty stated previously.  AISINK.COM will, at our option, replace the defective product or issue a credit for the full purchase price of the defective product.  

Compatible & Refurbished Maintenance Kits and printer parts
Compatible and Refurbished Maintenance kits and printer parts are guaranteed to be free from defects in materials and workmanship for 90 days, unless otherwise specified.  AISINK.COM will, at our option, replace the defective product or issue a credit for the full purchase price of the defective product.  

Genuine Brand Products
All Genuine Brand (OEM) Products are guaranteed to be free from defects in materials and workmanship for 90 days from the original invoice date. Any warranty information contained within the Technical Specifications section of the individual item(s) supersedes the warranty stated previously. AISINK.COM will, at our option, replace the defective product or issue a credit for the full purchase price of the defective product.
